The Harry Fox Agency Signs Digital Background Music Licensing Agreement with TruSonic

March 2, 2004 - The Harry Fox Agency, Inc. (HFA), the premier U.S. mechanical licensing organization, announced today that it has entered into an agreement with TruSonic, a business music and messaging service. Under the agreement, the Harry Fox Agency will provide licensing for songs from its affiliated music publishers for digital background music played on TruSonic equipment. This marks the first time HFA has entered into an arrangement for this type of service.

TruSonic delivers sound recordings over the Internet to secure proprietary digital storage devices that play background music in commercial establishments. Since the service creates a server copy, which is then distributed to clients, a mechanical license is required. HFA will issue licenses and collect and distribute royalties for the compositions it represents.

Using a web-based interface, TruSonic's customers are able to schedule and select among pre-established and custom lists of songs, download the selected playlists to their local devices, and play back the music. Current TruSonic subscribers include Petco Pet Supplies, Spencer Gifts, Comp USA, Champs Sports, O'Charley's Restaurants, Rubio's Baja Grill, Great Clips Hair Salons, AMC Theatres, Books-A-Million Booksellers, Affiliated Foods Midwest, IGA Grocery Stores, HealthMart Pharmacies, the Minneapolis-St Paul Airport and the Maryland Motor Vehicle Administration, among others.

"While the digital revolution has brought challenges to the music industry, it also brings new opportunities," said Gary Churgin, president and CEO, The Harry Fox Agency. "Digital delivery gives businesses a comprehensive business model that can provide a potentially unlimited variety of music in a retail environment."

"Working with The Harry Fox Agency is an easy way for TruSonic to reach the over 27,000 music publishers represented by The Harry Fox Agency," said Dan O'Neill, executive vice-president and CTO, TruSonic, Inc. "Licensing is such an important part of the success our company. No one else can provide access to such a vast number of music publishers."
